Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of invictatire.com (the "Site"), operated by Invicta Rubber LLC ("Invicta," "we," "us," or "our"), a wholesale-direct manufacturer of UTV/SXS and ATV tires based in Palm Springs, CA. By browsing the Site, creating an account, or placing an order, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Site.

We may update these Terms from time to time as described in Section 15. Continued use of the Site after changes take effect constitutes acceptance of the revised Terms.

Eligibility

You must be at least 18 years old and capable of forming a binding contract to place an order on the Site. By using the Site you represent that you meet these requirements. Accounts registered by "bots" or automated methods are not permitted and may be terminated without notice.

Accounts & Registration

You may browse the Site as a guest, but certain features — order history, saved vehicles in the Fitment Finder, dealer wholesale pricing — require a registered account.

• You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
• You agree to provide accurate, current, and complete information during registration and checkout, and to keep that information up to date.

• We reserve the right to suspend or terminate accounts that violate these Terms, provide fraudulent information, or are used for resale outside an approved dealer relationship.

Orders & Pricing

All prices on the Site are listed in U.S. dollars and reflect wholesale-direct pricing — no dealer markup. We reserve the right to correct pricing errors at any time, including after an order has been placed, and to cancel any order affected by a pricing or listing error with a full refund of amounts paid.

Placing an order is an offer to purchase, which we may accept or decline. An order is not accepted until we send a shipping confirmation. We may limit or cancel quantities purchased per person, household, or order, and may refuse any order at our discretion, including orders that appear to be placed by dealers, resellers, or automated purchasing systems outside of our Dealer Program.

Product availability, fitment data, and specifications are provided for guidance and may contain inaccuracies. Always confirm fitment for your specific year, make, model, and trim using the Fitment Finder or by contacting our team before ordering.

Payment

We accept the payment methods displayed at checkout. By submitting an order you authorize us (or our PCI-compliant payment processor) to charge your selected payment method for the full order total, including applicable tax and shipping. Card data is never stored on our servers — see our Privacy Policy for details.

For backordered items, your card is authorized but not charged until the item ships. If a payment is declined or reversed, we may suspend or cancel the associated order.

Shipping, Title & Risk of Loss

Full shipping timelines, carriers, and delivery estimates are published in our Shipping Policy. Title to purchased products and risk of loss pass to you upon our delivery of the item to the carrier. If a shipment is lost or damaged in transit, contact us and we will assist with a carrier claim in accordance with our Shipping Policy.

Returns

Unmounted, unused tires may be returned or exchanged within 30 days of delivery, subject to the condition requirements, process, and exceptions described in full in our Return Policy, which is incorporated into these Terms by reference.

Warranty & Disclaimers

Products sold on the Site may be covered by a manufacturer's limited warranty against defects in materials and workmanship; warranty terms, if any, are provided with the product or on its product page. Manufacturing-defect claims are handled directly by Invicta, since we mould the tires we sell.

Limitation of Liability

To the fullest extent permitted by law, Invicta Rubber LLC and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, or data, arising out of or related to your use of the Site or any product purchased through it, even if advised of the possibility of such damages. Our total liability for any claim arising from these Terms or your order will not exceed the amount you paid for the product(s) giving rise to the claim.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

Indemnification

You agree to indemnify and hold harmless Invicta Rubber LLC from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your violation of these Terms, misuse of the Site, or improper installation, mounting, or use of any product purchased from us — including use of a tire outside its rated size, load, or terrain specification.

Intellectual Property

All content on the Site — including text, graphics, logos, product photography, fitment data, and the Invicta name and marks — is the property of Invicta Rubber LLC or its licensors and is protected by U.S. and international intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from Site content without our prior written consent, except for personal, non-commercial use in evaluating a purchase.

Prohibited Use

You agree not to:

• Use the Site for any unlawful purpose or in violation of these Terms.
• Attempt to gain unauthorized access to the Site, other accounts, or our systems.
• Scrape, harvest, or systematically extract product, pricing, or fitment data without our written permission.
• Interfere with or disrupt the Site's operation, servers, or networks.
• Submit false, fraudulent, or misleading information when placing an order or applying to the Dealer Program.
• Resell products purchased at wholesale-direct consumer pricing without an approved Dealer Program agreement.

Dealer Program Terms

Approved dealers receive access to tiered wholesale pricing and dealer-only ordering tools in exchange for agreeing to program-specific terms, which may include minimum order quantities, territory guidelines, and resale conduct standards. Dealer Program participation is subject to application and approval, and Invicta may suspend or terminate a dealer account for violation of program terms, these Terms, or applicable law. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Arizona, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or your use of the Site will first be addressed through good-faith informal negotiation by contacting us at This email address is being protected from spambots. If a dispute cannot be resolved informally within 30 days, it will be resolved through binding arbitration on an individual basis in Maricopa County, Arizona, except that either party may bring an individual action in small claims court. You and Invicta each waive any right to a jury trial or to participate in a class action.

Changes to These Terms

We may revise these Terms at any time by posting an updated version on this page and updating the "Last Updated" date. Material changes will be highlighted on our home page for at least 30 days. Your continued use of the Site after changes take effect constitutes your acceptance of the revised Terms.
